Privacy Policy

Jagua Place Inc. ("Jagua," "we," "us," "our") operates jagua.ai and provides senior care navigation and placement services in California. This policy explains what information we collect, why, who we share it with, and the choices you have.
Two commitments frame everything below.
We do not sell your information to lead brokers, data brokers, or advertising networks. Not now, and we do not reserve the right to later without telling you first.
We share your information with a care facility only when you ask us to. Each introduction requires your specific, affirmative confirmation naming that facility. Submitting a form or talking to our assistant does not release your information to anyone.
Who this policy covers
This policy applies to families and individuals who use our website, our AI assistant, and our placement services, and to people whose information a family member provides to us on their behalf.
If you are the person needing care and a family member contacted us on your behalf, this policy applies to your information too. You have the same rights described below and may exercise them directly by contacting us.
This policy does not cover facilities. Once you ask us to introduce you to a facility and we send your information, that facility becomes an independent controller of your information under its own privacy practices. Ask the facility for its policy.
Information we collect
Information you give us. Name, contact details, ZIP code or city, relationship to the person needing care, and details about that person's situation — age, mobility, memory and cognition, medical conditions relevant to care level, medications requiring assistance, behaviors requiring supervision, budget, funding sources including Medi-Cal or VA benefits, preferred location, and timing. You choose how much to share. We ask only what we need to identify facilities licensed for the required level of care.
Conversations. The full text of your conversations with our AI assistant, notes from calls with our specialists, emails, and text messages. Calls may be recorded or transcribed; you will be told at the start of the call and may decline.
Automatically collected information. IP address, browser and device type, operating system, referring page, pages viewed, time on page, and general location inferred from IP. See our Cookie and Tracking Notice for what runs, when, and how to control it.
Information from other sources. Public regulatory records about facilities (not about you). Where you tell us a referral partner sent you — for example a Veterans Service Organization, hospital discharge planner, or case manager — we may receive your name and contact details from them.
Sensitive information
Some of what you share is health-related and some concerns an elderly or disabled person. We treat this as sensitive. We collect it only to identify facilities licensed and equipped for the required care level, we limit internal access to staff who need it, and we do not use it for advertising, profiling for advertising, or any purpose unrelated to your placement.
Jagua is not a HIPAA covered entity or business associate for the services described in this policy, and this policy is not a HIPAA Notice of Privacy Practices. If that changes — for example if we contract with a health plan or health system — we will update this policy and provide the required notices before the change takes effect.
Why we use your information
- To answer your questions and identify facilities that match the required care level, location, and budget.
- To introduce you to specific facilities you ask us to contact.
- To schedule tours and appointments and follow up on your placement.
- To support you after a move where you ask us to.
- To operate, secure, debug, and improve the Services, including reviewing conversations for quality and safety.
- To meet legal obligations, including facility licensing verification, recordkeeping of our fee disclosures, and mandated reporting of suspected unlicensed or unsafe facilities.
- To send you service messages, and marketing messages where you have opted in.
We do not use your information to train AI models, and our contracts with our AI providers do not permit them to use your conversations to train their models. Conversations are processed to generate a response to you and for the quality and safety review described below, and for nothing else.
Who we share it with
Care facilities and providers — only at your direction. Before any introduction we tell you which facility will receive your information and what will be shared, and you must confirm. We share what the facility needs to assess fit and contact you. We do not send your information to facilities you have not selected, and we do not distribute a single inquiry across a network of providers.
Service providers who work for us. They may process your information only to provide services to us, under written contract, and may not use it for their own purposes. Current categories and providers:

We will update this table when providers change.
Referral partners. Where a Veterans Service Organization, hospital, or case manager referred you and asked to be told the outcome, we confirm only that a placement occurred and where, and only with your permission.
Legal and safety. We may disclose information to comply with law or valid legal process, to enforce our Terms, to report suspected unlicensed or unsafe facilities or suspected elder abuse as required by California law, or to protect the rights or safety of any person.
Business transfers. If Jagua is involved in a merger, acquisition, financing, or sale of assets, your information may transfer as part of that transaction. We will require the recipient to honor this policy or give you notice and a meaningful choice before any materially different use.
Aggregate and de-identified information. We may publish statistics about placements, costs, wait times, and outcomes that cannot reasonably be used to identify you. We commit not to attempt reidentification and to require the same of recipients.
Selling and sharing
We do not sell personal information, and we do not share it for cross-context behavioral advertising, as those terms are defined by California law.
When we pass your information to a facility, we do so because you directed us to. We rely on that direction rather than treating the transfer as a sale, which is why each introduction requires your specific confirmation and why we log it. Facilities pay us a fee when a family we introduce moves in; that fee is disclosed to you before any introduction and is explained in our Referral Fee and Financial Interest Disclosure. The fee is paid for the introduction and our work on the placement, not for your data.
Your choices and rights
Regardless of whether we are legally required to offer them, we honor the following for anyone who uses our Services:
- Know what personal information we hold about you and how we have used and disclosed it.
- Access a copy in a portable format.
- Correct inaccurate information.
- Delete your information, subject to records we must retain by law.
- Withdraw consent to further introductions or communications at any time.
- Opt out of marketing messages via the unsubscribe link, by replying STOP, or by contacting us.
- Non-discrimination. We will not deny you service or provide a lesser standard of service because you exercised any of these rights.
To exercise any right, email info@jagua.ai or write to the postal address at the end of this policy. We will verify your identity before acting and will respond within 45 days, extendable once by another 45 days with notice. An authorized agent — including a family member holding a power of attorney or acting as a substitute decision maker — may submit a request with proof of authority.
California "Shine the Light." California residents may request information about disclosure of personal information to third parties for their direct marketing purposes. We do not make such disclosures. Direct any request to info@jagua.ai.
Do Not Track
Some browsers send a Do Not Track signal. There is no industry consensus on how to interpret it. We do not currently respond to Do Not Track signals. We do honor Global Privacy Control signals as an opt-out of any sharing for advertising purposes, and our Cookie and Tracking Notice explains the controls we do provide.

Security
We use encryption in transit and at rest, role-based access controls, least-privilege service accounts, audit logging, and vendor security review. No system is perfectly secure. If a breach affecting your personal information occurs, we will notify you as required by California Civil Code sections 1798.29 and 1798.82.
Children
Our Services are not directed to anyone under 18 and we do not knowingly collect information from children. If you believe a child has provided us information, contact info@jagua.ai and we will delete it.
Information outside California
Our Services are intended for California residents. If you access the Site from elsewhere, your information will be processed in the United States, which may not provide the same protections as your jurisdiction.
Changes
We may update this policy. We will revise the Effective Date and, for material changes, provide prominent notice on the Site and by email where we have your address, before the change takes effect.
